| For those of you who do market stalls do you have public liabilty?? I was interested in doing a market at one of the local schools and rang for an application form and she asked if I had insurance, which i said No, then asked if I was a business, which I said No. So I was told I can't have a stall. It's a bit of a let down, as I have had a stall at another local school's fete (which is once a year) and they just ask you to pay an extra $5.00 on top of the stall fee so you are covered for insurance, which I think is fair. It would be nice if the local schools would support local craft makers!!!! | |

| Hi Rosie,
Look under General chat a post on the May 27th by me (Michelle), I asked the same question and had lots of great advise. I did have lots of trouble getting insurance but ending up going through City Rural Insurance brokers in SA. As soon as I mentioned bows for Babies I had lots of knock backs. I have been attending a few markets and some you must have your own insurance others you can just purchase theirs.

| hi i havnt thought of this . is it just onsite insurance incase you hurt yourself or someone hurts therselves on your site? or is incase a lil one chokes on an attachment on the bows? | |

| In case someone chokes or hurts themselves with the product. I found lots of insures would insure me untill I mentioned the word "baby" then it was the end of the conversation, thats why I went through Rural insurance brokers. If you find another one please let me know.

| Hi,
The advise I was given is, If you trade under any name other then your own (personal name) you must be a registered business to display this name at the markets. So legally you cannot display "Kustom Korkers & Bows at the markets in NSW unless you have registered a business name. Not sure how many people at the markets do this or know about it.
At the markets the person who runs the markets may be able to offer you insurance, if not you should have your own, if somebody trips on your stand or injures themselves it would fall back on you.
This is the advise have been given, you may want to check it out for yourself to confirm it, the ATO and ASIC websites have lots of info.

| Thanks michelle iv registered my business name but its not classed as a company/business cause its not high enoug income as yet so i can still class it as a hobby business but cant get insurance im as cofused as u sounded in ur first topic post lol .. but i spoke to my market person they dont care what you got or dont its buy at your own risk so i guess it takes all responsibility of stall holders n organisers / what if u had lil stickers made up on products that said "contains small parts could cause choking hazard if not supervised or something " would this take away any blame ?i just wanna be able to make cute things for lil girls y does it have to be soo confusing grr | |

| I started the same, registered a business name but with a low income. You should be able to get insurance for the markets though.
With the markets if they don't care if you have insurance or not. I would find out who would be liable if somebody did injure themselves. You don't want it to fall back onto you if something did happen.
I have a similar disclaimer on my products and also display a sign at the markets, but I don't think that takes away all responsibility, people will try to sue for anything these days.
Lets face it the chances of something happening a quite slim, most mums know that kids put things in their mouths and will keep an eye on them. But in my opinion its better safe than sorry, I'd rather pay my insurance then lose my house.
Does any body else out there have suggestions?
